Terms of Service

1. Agreement to These Terms

Florivo ("we", "our", or "us") is operated by McCartney Marketing LLC. These Terms of Service govern your access to and use of the Florivo application and services at florivo.io. By creating an account or using Florivo, you agree to these Terms. If you do not agree, please do not use the service.

2. What Florivo Does

Florivo is a social media management platform for small business owners and creators. It lets you connect your own Facebook and Instagram accounts to create, schedule, and publish content, view analytics, set up messaging automations, and manage advertising campaigns on your own connected Meta accounts.

3. Your Account

You must be at least 18 years old and able to form a binding contract to use Florivo. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Please notify us right away if you believe your account has been used without your permission.

4. Acceptable Use

When you use Florivo, you agree that you will not:

• Violate any law or the terms and policies of Meta or any other connected platform
• Publish content that is unlawful, misleading, harmful, or infringes someone else's rights
• Send spam, unsolicited messages, or automations that break Meta's messaging rules
• Attempt to access accounts or data that do not belong to you
• Interfere with, disrupt, or reverse engineer the service

5. Connected Accounts and Third-Party Services

You only connect accounts you own or are authorized to manage. When you connect a Facebook or Instagram account, your use of that data is also governed by the Meta Platform Terms and Meta's policies. Florivo relies on trusted third-party providers, including Meta Platforms, Stripe for payments, Supabase for data storage, and Anthropic for AI-powered features. Your use of those integrations is subject to their respective terms.

6. Subscriptions and Billing

Paid plans are billed on a recurring basis through our payment processor. Fees are stated at the time you subscribe. You can cancel at any time, and cancellation takes effect at the end of your current billing period. Unless required by law, fees already paid are not refundable. We will give reasonable notice before any change to pricing.

7. Your Content

You keep ownership of the content you create and publish through Florivo. You grant us a limited license to store, process, and transmit that content only as needed to operate the service on your behalf, such as scheduling and publishing a post to your connected account. You are responsible for making sure you have the rights to the content you publish.

8. Intellectual Property

Florivo, including its software, design, and branding, is owned by McCartney Marketing LLC and is protected by intellectual property laws. These Terms do not grant you any right to our name, logo, or other brand assets except as needed to use the service normally.

9. Disclaimers

Florivo is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error free, or that any particular business or marketing result will occur. Analytics and third-party data are provided for convenience and may not always be complete or accurate.

10. Limitation of Liability

To the fullest extent permitted by law, McCartney Marketing LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of Florivo. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

11. Termination

You can stop using Florivo and delete your account at any time (see our Data Deletion page). We may suspend or end your access if you violate these Terms or use the service in a way that could harm other users, us, or a connected platform.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page. If a change is significant, we will make a reasonable effort to let you know. Continuing to use Florivo after an update means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which McCartney Marketing LLC is organized, without regard to conflict of law rules.
